Des groupes de la société civile appellent à la libération de Tep Vanny

L'activiste et défenseuse des droits humains Tep Vanny est injustement détenue depuis deux ans aujourd'hui, pour avoir défendu les droits de la communauté du lac Boeung Kak et de ses concitoyens cambodgiens. Nous, les organisations de la société civile et communautés soussignées, condamnons son maintien en détention et appelons les autorités à libérer immédiatement et sans condition Tep Vanny, à abandonner toutes les accusations criminelles en sommeil et à infirmer toute inculpation contre elle afin qu'elle puisse rentrer auprès de sa famille et de sa communauté.

Tep Vanny a lutté sans relâche pour protéger les droits des membres de sa communauté suite à leur expulsion forcée de leurs maisons sur le lac Boeung Kak, Phnom Penh, mais aussi ceux de ses collègues défenseur-ses des droits humains qui militent pour d'autres causes. Tant qu'elle est derrière les barreaux, Tep Vanny ne peut pas mener à bien son travail pacifique et précieux.

"Nous devons partager tous les bénéfices de notre expérience. Si nous nous dressons tous ensemble, nous pouvons obtenir justice", a déclaré Tep Vanny. "Si les communautés se rassemblent, nous avons un grand pouvoir".

Tep Vanny a été arrêtée lors d'une manifestation pacifique le 16 août 2016, qui avait pour but de remettre en question la détention arbitraire de quatre défenseur-ses des droits humains et d'un représentant des élections. Le 22 août 2016, elle a été inculpée pour avoir "insulté un fonctionnaire" et condamnée à six jours de prison. Cependant, au lieu de la libérer en se basant sur la durée purgée, les autorités ont repris des accusations en sommeil datant de 2013 et liées à une manifestation pacifique, et l'ont condamnée à deux ans et demi de prison et à une amende de 14 millions de riels (environ 3500$). À ce jour, les demandes de Tep Vanny pour être graciée ont toutes été rejetées. Ses nombreux procès et appels sont loin d'avoir respecté les normes pour un procès équitable ; les preuves présentées ne respectaient pas la charge de la preuve requise pour prononcer une inculpation.

"En tant que victime d'expulsion, je peux garantir que Tep Vanny n'a pas fait usage de violence ni fait quoi que ce soit de mal. J'en miserai ma vie", a déclaré Bov Chhorvy, militant du lac Boeung Kak. "Les autorités devraient la libérer afin qu'elle puisse être avec sa famille. Ses enfants et sa mère ont besoin d'elle".

Sa détention excessivement longue, en plus d'avoir un impact personnel négatif, prive aussi ses deux enfants d'une enfance normale car ils ne voient leur mère qu'une fois par mois. La dégradation de la santé de la mère de Tep Vanny est aggravée par le traitement injuste de sa fille. L'impossibilité de prendre soin de sa famille place une charge psychologique supplémentaire sur Tep Vanny, exacerbée par sa détention dans l'une des pires prisons du Cambodge, où elle partage une cellule avec plus de 150 autres prisonnières dans des conditions sordides. Les représentants de la société civile ainsi que les membres de la communauté du lac Boeung Kak sont fréquemment repoussés lorsqu'ils tentent de lui rendre visite en prison, ce qui accentue le sentiment d'isolement sans sa famille et de ses amis, ce qui viole l'Ensemble de règles minima pour le traitement des détenus adopté par l'ONU.

Nous appelons les autorités cambodgiennes à libérer Tep Vanny immédiatement et sans condition, à abandonner toutes les accusations portées contre elle ainsi que mettre fin à l'enquête dont elle fait l'objet. Cela permettra de garantir qu'elle puisse continuer son travail en faveur des droits humains et plus important, qu'elle retrouve sa famille et sa communauté. Enfin, nous exhortons les autorités à cesser les actes d'intimidation et de harcèlement contre Tep Vanny et tous les autres militants, notamment les arrestations, les poursuites et l'emprisonnement.
