We demand the end of the systematic criminalization policy against human rights defenders in Venezuela

"We call for the guarantee, respect, and promotion of the work of human rights defenders."

The human rights organizations and individuals who sign this statement condemn the attacks and aggressions committed against those who defend human rights and do humanitarian work in Venezuela. We demand the immediate end to the policy of criminalization carried out by officials of the Venezuelan State. The right to defend human rights must be guaranteed, protected, and promoted in Venezuela.

Since 2002, State authorities have developed a policy of criminalization of the defense of human rights. Through the use of hateful and slanderous speech, broadcasted through public and State media, officials pretend to discredit the work of organizations and persons who defend human rights, accompany victims, and take humanitarian action. These acts have promoted the execution of violent actions which affects the work of defense of human rights, as it puts the life and personal integrity of those who have been affected by the Venezuelan crises and create additional obstacles to this line of work.

For the past 5 years, the attacks against the Venezuelan human rights movement have obeyed to the thesis of the alleged existence of an internal enemy who seeks to destabilize the peace of the nation. As a result, the movement has been affected, not only by stigmatization and the attempts of delegitimizing human rights work through hateful and slanderous speech, but also by the application of restrictive legislation, legal action, aggressions, digital attacks, persecution, arbitrary raids, arbitrary detention, criminalization of international cooperation, the confiscation of materials, amongst other attacks, which has harmed and hindered the defense of human rights.

The policies of repression and control have facilitated the abuse of authority by public officials, many of a high rank, generating a hostile environment which, amidst a complex humanitarian emergency, makes the legitimate work of civil society organizations increasingly difficult. This situation also inhibits victims from denouncing violations or seeking assistance, in addition to exposing them to the violence and insecurity given the high crime and impunity rates.

Organizations that promote and defend the right to health, food, people who do humanitarian work, medical assistance, and nursing professionals have been victims of harassment and reprisals, arbitrary raids, arbitrary detentions and aggression in the past two years after denouncing abuses in support of vulnerable populations. They are considered to be agents who promote military intervention.

There has also been an upsurge in the repression against unionists and workers, who have been victims of persecution, incarceration, threats, and aggression. Indigenous and environmental human rights defenders have also been victims of harassment and reprisals for reporting the abuses caused by the exploitation of natural resources in the Arco Minero del Orinoco and other areas of the country. Community organizations and activists, students, and committees of victims have also been subjected to threats as a reprisal for demanding the restoration of their rights or for denouncing violence and abuses in their communities and daily spaces.

In this context, it is necessary that in Venezuela, those of us who defend human rights can do so in a safe and conducive environments, which guarantee that we may engage in our peaceful and legitimate activities without undue restrictions or fear of harassment, threats, or reprisals.

For these reasons, we demand that the Venezuelan State:

1. Immediately cease all forms of criminalization, intimidation, harassment, delegitimization, and aggression. We also demand that the State abstains from imposing arbitrary limitations and restrictions to the right of association and freedom of assembly.
2. Implement the necessary mechanisms to promote and guarantee a conducive and safe environment for those who defend human rights in Venezuela, along with the creation of effective mechanisms for the protection of those who defend human rights.
3. Take every measure necessary to ensure that State officials, and other public figures, abstain themselves from making declarations which stigmatize the legitimate work of human rights defenders.
4. Investigate and sanction those responsible for committing aggressions against human rights defenders in Venezuela, both State actors and non-State actors.
5. Effectively apply the “Declaration on the Right and Responsibilities of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms”, known as the Declaration on human rights defenders, adopted by the United Nations General Assembly on the December 9, 1998.
