Zhalaudi Geriev sentenced to three years imprisonment - September 2016
On 30 April 2019, Zhalaudi Geriev was released from prison in Chernokozovo, Chechnya after serving his sentence in full. The human rights defender was sentenced to three years imprisonment on trumped-up charges of “violating the rules of turnover of narcotic drugs and psychotropic substances” by the Shali District Court of Chechnya on 5 September 2016.
On 28 December 2016, the Supreme Court of Chechnya affirmed a court decision against human rights defender, Mr. Zhalaudi Geriev, who was convicted and sentenced in September to three years imprisonment on charges of drug possession.
On 5 September 2016, the Shali District Court of Chechnya sentenced human rights defender Mr Zhalaudi Geriev to three years imprisonment on fabricated charges of drug possession. The human rights defender was arrested on 16 April and placed in pre-trial detention.
Zhalaudi Geriev is a human rights defender and independent journalist who works for the online news portal Caucasian Knot, a Russian media portal covering current developments in the Caucasus and well known for its reporting on abuses by Chechen authorities,

The human rights defender was sentenced to three years imprisonment on trumped-up charges of “violating the rules of turnover of narcotic drugs and psychotropic substances” by the Shali District Court of Chechnya on 5 September 2016.
On 18 September 2018, a judge of the Naursky Regional Court issued a decision to release the human rights defender on parole after he had served three quarters of his sentence. However, on 8 November 2018, this decision was overruled by the Supreme Court of Chechnya on the request of the prosecutor.
Prosecution under criminal charges related to the possession and turnover of drugs is a tactic commonly used by the Chechen authorities to silence human rights defenders. On 18 March 2019, the Shali District Court charged another Chechen human rights defender, Oyub Titiev, with the same offence and sentenced him to four years in a prison colony settlement.
While Front Line Defenders welcomes the release of Zhalaudi Geriev, it condemns his unjust arrest and imprisonment, and remains concerned about the pattern of criminalisation and intimidation against human rights defenders in Chechnya.

On 28 December 2016, the Supreme Court of Chechnya considered an appeal against the judgement of the Shali District Court in relation to Zhalaudi Geriev, who was convicted and sentenced to three years imprisonment on charges of drug possession in September. Zhalaudi Geriev’s lawyer asserted that neither the Supreme Court of Chechnya nor the Shali District Court introduced any evidence to support the allegations made against the human rights defender. The court only referenced a confession made by Zhalaudi Geriev which he stated at his original trial was forced and which he withdrew.
On 16 April 2016, Zhalaudi Geriev was arrested by three armed police officers in Kurchaloi and transferred to Grozny. He was forced to sign a confession stating that a large package of marijuana found in his backpack, which he denied any knowledge of, belonged to him and he was placed in pre-trial detention. On 5 September 2016 Shali District Court of Chechnya found Zhalaudi Geriev guilty of “violating the rules of turnover of narcotic drugs and psychotropic substances”, under article 228 of the Russian Criminal Code and sentenced him to three years imprisonment.
Front Line Defenders strongly condemns the decision of the Supreme Court to uphold fabricated charges brought against Zhalaudi Geriev, as well as the heavy sentencing, as it is believed to be solely related to his peaceful and legitimate work reporting human rights abuses in Chechnya. Front Line Defenders calls on the Russian authorities to immediately and unconditionally release Zhalaudi Geriev and quash his conviction.

The sentencing of the human rights defender to three years imprisonment followed his arrest on 16 April 2016. Zhalaudi Geriev was dragged from a bus and forced into a vehicle by three armed police officers while travelling from Kurchaloi to Grozny. The police officers took his two phones and backpack, tied his hands with wire, and drove him to a forest 35 kilometres from Grozny, in the Kurchaloi district of Chechnya. The police officers questioned him about his work, and accused him of being a member of terrorist organisation. A plastic bag was placed tightly over Geriev’s head, and removed before he was about to suffocate.
The police officers then took Geriev to a cemetery on the outskirts of Kurchaloi, where they “officially” arrested him for “violating the rules of turnover of narcotic drugs and psychotropic substances”, under article 228 of the Russian Criminal Code. This charge is based on a large package of marijuana which was planted in the backpack of the human rights defender, the same one which was taken from him earlier by police officers. Zhalaudi Geriev was brought to Kurchaloi police station, forced to sign a confession stating the drugs in his backpack belonged to him and placed in pre-trial detention.
On 14 June 2016, the trial of Zhalaudi Geriev began in Shali District Court, the human rights defender withdrew his confession saying it was made under pressure, however the court failed to consider this. During the trial, Geriev's lawyer insisted that there were significant gaps and flaws in the preparation of procedural documents, including inspection reports of the crime scene, Geriev's interrogation and multiple violations of criminal procedure. On 31 August 2016, the prosecutor requested that Zhalaudi Geriev be sentenced to five years imprisonment and one year of restraint of liberty. On 5 September 2016, Shali District Court of Chechnya sentenced the human rights defender to three years imprisonment. His lawyers plan to appeal to the Supreme Court of Chechnya to quash the conviction completely.
Front Line Defenders strongly condemns the fabricated charges brought against Zhalaudi Geriev, as well as the heavy sentencing, as it is believed to be solely related to his peaceful and legitimate work reporting human rights abuses in Chechnya.
Front Line Defenders urges the authorities in the Russian Federation to:
1. Ensure the immediate release of Zhalaudi Geriev and quash the sentence against him;
2. Return the items confiscated, as they are manifestly not linked to any criminal activity;
3. Guarantee in all circumstances that all human rights defenders in Russia are able to carry out their legitimate human rights activities, nationally and internationally, without fear of reprisals and free of all restrictions including judicial harassment.
